Questions to Ask Regarding Medical Malpractice

If you suspect that your child’s cerebral palsy may have been caused by negligence on the part of a doctor, nurse, midwife or hospital technician please take a moment to consider the following questions.  If the answer to any of the questions is “yes” it is highly likely that a mistake was made that lead to your child’s cerebral palsy.

  • Did the medical staff fail to order tests and/or fail to properly interpret any of the tests during my pregnancy, labor and/or delivery?
  • Did my child sustain injuries or bruises before, during, or after birth?
  • Did the doctor and/or medical staff fail to diagnose changes in my baby's heart rate, oxygen flow and/or neglect other important factors during pregnancy or delivery?
  • Did my child need to be resuscitated after birth?
  • Was my baby delivered with a vacuum, forceps or by a C-section?
  • Did the medical staff/doctor fail to perform an emergency C-section?
  • Did the doctor and/or medical staff fail to deliver my baby in a safe and timely manner?
  • Did my baby have seizures after birth?
  • Was my labor too long?
  • Was oxygen required after birth to aid my child’s breathing?
  • Did I develop an infection like Rubella, German Measles, Toxoplasmosis or a urinary tract infection (UTI), or kidney infection while pregnant?
  • Did my doctor delay or withhold medication for an infection?
  • Did my doctor test me for Rh incompatibility?
  • Did my baby need special testing after he/she was born such as an MRI or brain scan?
  • Did my child get stuck in the birth canal for a period of time?
  • Did I experience a rupture of my placenta (placental abruption) or did my placenta become inflamed?
  • Did I have preeclampsia/hypertension (high blood pressure before or during pregnancy) that was not dealt with properly?
  • Was my child delivered more than 24 hours after my water broke?
  • Did I have a fever in excess of 100.1 F during pregnancy?
  • Did my baby have low APGAR scores?
  • Did the doctor fail to stop my early delivery? Did the doctor try to stop an early delivery?
  • Was my baby jaundice?
